Terms of Service

These Terms of Service (“Terms”) constitute a binding legal agreement between you and MG5 Pty Ltd (trading as Maths and Science Buddy) (“we”, “us”, “our”), a company incorporated in South Africa, governing your access to and use of mathscibuddy.co.za and all associated products and services (the “Platform”).

If you are under 18 years of age, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Maths and Science Buddy provides a curriculum-aligned online learning platform for South African Grade 8–12 learners, including:

• Past exam paper library with official DBE memoranda.
• AI-powered StudyBuddy tutor (CAPS-aligned question and answer).
• Interactive SciLab and MathLab simulations.
• Gamified CAPS question engine.
• CAPS-aware time management and study planning tools.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with reasonable advance notice where possible.

To access the Platform you must register for an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials. Notify us immediately at support@mathscibuddy.co.za if you suspect unauthorised access.

Certain features require a paid subscription. All fees are quoted and charged in South African Rand (ZAR). Subscriptions renew automatically each month until cancelled. Payments are processed securely by PayFast (Pty) Ltd, a PCI DSS-compliant payment gateway.

You may cancel your subscription at any time from your account dashboard. Upon cancellation, you retain access until the end of your current billing period. We do not offer prorated refunds for partial billing periods except where required by the Consumer Protection Act 68 of 2008 (CPA).

Under the CPA, consumers may cancel a fixed-term agreement with 20 business days' notice. Any applicable early cancellation fees will not exceed a reasonable penalty as prescribed by CPA Regulation 5(2).

You agree not to:

• Share your account credentials with others or allow multiple users to share one account.
• Scrape, copy, or redistribute our content without written permission.
• Attempt to reverse-engineer, decompile, or access the platform's source code or databases.
• Upload or transmit malicious code, spam, or unlawful content.
• Use our platform for any commercial tutoring or resale purpose without a written partnership agreement.
• Circumvent or attempt to circumvent access controls or subscription paywalls.

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.

All content on the Platform — including past papers sourced under fair educational use, our game questions, AI-generated explanations, simulation software, branding, and design — is owned by or licensed to MG5 Pty Ltd (trading as Maths and Science Buddy).

Official DBE past papers are Crown copyright and reproduced under educational fair use guidelines for non-commercial learner benefit. We do not claim ownership of DBE materials.

Subject to your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial educational purposes.

The Platform is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by South African law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our AI tutor answers are error-free. Always verify critical answers against your textbook or a qualified teacher.

To the maximum extent permitted by the Consumer Protection Act and applicable South African law, our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total fees you paid to us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, or consequential loss, including loss of exam marks, academic performance, or data.

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms shall first be submitted to good-faith mediation. If unresolved, disputes shall be referred to the courts of South Africa having jurisdiction.

Nothing in these Terms limits your statutory rights under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 20 business days before the changes take effect, in compliance with the Consumer Protection Act. Continued use of the Platform after the effective date constitutes acceptance.
